Terms and Conditions

These terms apply to everyone who uses www.aspigon209.co.za or buys anything from Aspigon 209. By using the site or paying for a product or service you agree to them. If you do not agree, do not use the site or buy from us.

1. What we sell

2. Prices

• All prices are in South African Rand (ZAR). The price you pay is the price shown on the site at the time of purchase, or the price in your written quote.
• We may change prices at any time. A change does not affect an order already paid. Subscription price changes are notified by email at least 30 days before they apply to your next billing.
• Quotes for consulting and web development are valid for 30 days unless the quote says otherwise.

3. Payment

• Online payments are processed by Payfast (a division of DPO South Africa). We never see or store your card or bank details.
• Payfast payment methods may include card, Instant EFT and other methods Payfast offers at checkout.
• Consulting and web development work is normally invoiced and paid by EFT to the bank account on the invoice. You may also pay these invoices through Payfast.
• An order is only confirmed once payment is received in full, or, for quoted work, once the agreed deposit is received.

4. Delivery

• Book: a download link is shown and emailed right after successful payment. If you do not receive it within 24 hours, email pierre@aspigon209.co.za with your Payfast payment reference.
• Body Health Check: access starts right after the first successful payment and continues while the subscription is active.
• Surviving & Winning Daily: your first payment opens lessons 1 to 30 and your second payment, one month later, opens lessons 31 to 42. Lesson 1 opens right after the first successful payment. After that one lesson unlocks each day at 06:00, and each lesson opens once you pass the short quiz at the end of the previous one. Lessons you have unlocked stay available after the course ends or if you cancel.
• Consulting and web development: delivered on the timeline in your quote or agreement. Timelines depend on you supplying information, content and approvals on time.
• There is no physical delivery and no shipping fee.

5. Subscriptions

• Body Health Check renews automatically every month or every year, depending on the option you chose, until you cancel.
• Surviving & Winning Daily takes R150 on signup and R150 one month later, then stops automatically. No payment is taken after the second.
• Payfast charges the same card or account on each renewal date.
• You can cancel at any time. See the Refund and Cancellation Policy.

6. Consulting and web development work

• Each engagement is governed by a written quote or agreement. If that document conflicts with these terms, the written quote or agreement applies.
• Web development projects require a deposit before work starts. The balance is payable as set out in the quote, normally on completion and before handover or go-live.
• Ownership of custom code and designs passes to you once the project is paid in full, unless the agreement says otherwise. We may reuse general know-how, and non-client-specific components, tools and templates.
• Hosting, domain and third-party service costs are your responsibility unless the quote includes them.
• Consulting advice is based on the information you give us. Business decisions and their results remain your responsibility. We do not guarantee any specific financial result.

7. Health information disclaimer

Body Health Check provides general nutrition information and meal plans. It is not medical advice, diagnosis or treatment. Speak to a doctor or registered dietitian before changing your diet, especially if you are pregnant, have a medical condition, food allergies, or take medication. You use the meal plans at your own risk.

8. Intellectual property

All content on the site, the book, the meal plans and all materials we supply are owned by Aspigon 209 or its licensors. You may use purchased products for your own personal or internal business use. You may not copy, resell, share, upload or distribute them without our written permission.

9. Your account and use of the site

• Keep your login details private. You are responsible for activity on your account.
• Do not misuse the site, attempt to access it without permission, or interfere with how it works.
• We may suspend access for misuse or non-payment.

10. Limitation of liability

To the extent the law allows, Aspigon 209 is not liable for indirect or consequential loss, loss of profit or loss of data. Our total liability for any claim is limited to the amount you paid for the product or service the claim relates to. Nothing in these terms limits rights you have under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002 that cannot lawfully be limited.

11. Security

The site uses SSL encryption. Payments are handled on Payfast's secure, PCI DSS compliant platform.

12. Privacy

How we handle your personal information is set out in our Privacy Policy.

13. Complaints and disputes

Send any complaint to pierre@aspigon209.co.za. We respond within 5 business days and aim to resolve it within 14 days. If we cannot resolve it, either party may refer the matter to the relevant consumer body or court.

14. Governing law

These terms are governed by the laws of the Republic of South Africa. You agree to the jurisdiction of the South African courts, and for matters within its limits, the Magistrate's Court with jurisdiction over Boksburg.

15. Changes to these terms

We may update these terms. The date at the top shows the latest version. Changes do not affect purchases already made.
